2020 was a record-breaking year for international commercial and investor-state arbitration—with several of the leading arbitral institutions reporting marked increases in their caseloads.
Despite the pandemic’s disruption, the ICC, LCIA and SIAC—some of the world’s most recognized arbitral institutions—reported increases of up to 125% in caseloads. In investor state institutions, ICSID reported a 48% increase in 2020. While arbitration remains a popular method of resolving international commercial and investor-state disputes, the process can require years of effort and exorbitant costs. Legal finance provides unique solutions to these issues and thus has become vital to the arbitration process around the world.
